Delgany Developer To Stand Trial Over Scaffold Death

Delgany developer is to go on trial at Dublin District Court over a 2019 scaffold fall that resulted in the death of a worker.

Karl McKeon suffered fatal injuries at or near a premises at Santry Avenue on December 18th, 2019, later dying at the Mater Hospital.

As reported by Tom Tuite in both Breaking News and The Irish Independent, both William O’Dwyer of Blackberry Lane, Delgany and the south Dublin-based builders Dwyer Nolan Developments Ltd are now set to stand trial for alleged breaches of health and safety laws.

With Judge Anthony Halpin granting a return for trial order, the case is now be listed for mention on December 11th.

Amongst four charges against the manager and the company, they are accused of failing to ensure that work at height was properly planned, appropriately supervised and carried out safely. Such failings, the charges claim, resulted in Mr McKeon’s personal injuries and death.

Dwyer Nolan Developments Ltd are also facing charges of failing to organise cooperation between contractors at the site, coordinate prevention of on-site accidents, or to identify hazards.

On Tuesday, the prosecution served the defendants with books of evidence.
